At MCDS each student and their parents are required to sign an Acceptable U=
se Policy (AUP,) which includes our website Terms of Use (TOU) policy incor=
porated therein, agreement summary stating that they read the policy and ag=
ree to it. This is done annually and the signed paperwork is kept on file =
in the Tech Department. The actual physical paper is part of a homework as=
signment for the student and is the reasoning behind printing it out. The =
TOU is on our website and use of the website by anyone else requires agreem=
ent to this policy. We "tune" these documents and associated summaries eve=
ry year. Below is our TOU for this year. What is not below is our AUP and=
the age appropriate summaries that are sent home as homework.

MCDS Terms of Use
These terms of use are subject to change and are kept current on the MCDS w=
eb site.
These terms are a part of the MCDS AUP.
The MCDS sites/services may contain email services, bulletin board services=
, chat areas, news groups, forums, communities, personal web pages, calenda=
rs, photo albums, file cabinets and/or other message or communication facil=
ities designed to enable you to communicate with others (collectively, "Com=
munication Services"). You agree to use the Communication Services only to =
post, send and receive messages and material that are proper and comply wit=
h Marin Country Day School Policy, when applicable, related to the particul=
ar Communication Service. By way of example, and not as a limitation, you a=
gree that when using a Communication Service, you will not:
* Use the Communication Service in connection with surveys, contests,=
pyramid schemes, chain letters, junk email, spamming or any duplicative or=
unsolicited messages (commercial or otherwise).
* Defame, abuse, harass, stalk, threaten or otherwise violate the leg=
al rights (such as rights of privacy and publicity) of others.
* Publish, post, upload, distribute or disseminate any inappropriate,=
profane, defamatory, infringing, obscene, indecent or unlawful topic, name=
, material or information.
* Upload files that contain software or other material protected by i=
ntellectual property laws (or by rights of privacy or publicity) unless you=
own or control the rights thereto or have received all necessary consents =
to do the same.
* Upload files that contain viruses, Trojan horses, worms, time bombs=
, cancelbots, corrupted files, or any other similar software or programs th=
at may damage the operation of another's computer or property of another.
* Advertise or offer to sell or buy any goods or services for any bus=
iness purpose, unless such Communication Service specifically allows such m=
essages or your have obtained written permission for such use by the MCDS D=
irector of Technology or MCDS Head of School.
* Download any file posted by another user of a Communication Service=
that you know, or reasonably should know, cannot be legally distributed in=
such manner.
* Falsify or delete any author attributions, legal or other proper no=
tices or proprietary designations or labels of the origin or source of soft=
ware or other material contained in a file that is uploaded.
* Restrict or inhibit any other user from using and enjoying the Comm=
unication Services.
* Violate any code of conduct or other guidelines which may be applic=
able for any particular Communication Service.
* Harvest or otherwise collect information about others, including em=
ail addresses.
* Violate any applicable laws or regulations.
* Create a false identity for the purpose of misleading others.
* Use, download or otherwise copy, or provide (whether or not for a f=
ee) to a person or entity any directory of users of an MCDS site/service(s)=
or other user or usage information or any portion thereof.
Marin Country Day School has no obligation to monitor the Communication Ser=
vices. However, Marin Country Day School reserves the right to review mater=
ials posted to a Communication Service and to remove any materials in its s=
ole discretion. Marin Country Day School reserves the right to terminate yo=
ur access to any or all of the Communication Services at any time, without =
notice, for any reason whatsoever.
Marin Country Day School reserves the right at all times to disclose any in=
formation as Marin Country Day School deems necessary to satisfy any applic=
able law, regulation, legal process or governmental request, or to edit, re=
fuse to post or to remove any information or materials, in whole or in part=
, in Marin Country Day School's sole discretion.
Always use caution when giving out any personally identifying information a=
bout yourself or your students in any Communication Service. Marin Country =
Day School may not control or endorse the content, messages or information =
found in any Communication Service and, therefore, Marin Country Day School=
specifically disclaims any liability with regard to the Communication Serv=
ices and any actions resulting from your participation in any Communication=
Service.
Materials uploaded to a Communication Service may be subject to posted limi=
tations on usage, reproduction and/or dissemination; you are responsible fo=
r adhering to such limitations if you download the materials.

Subject: Parent use of email lists
We would like to add a policy to our parent handbook regarding parent
use of email addresses for solicitation. Some parents won't give us
email addresses for communication because they are worried they will
also receive emails from other parents regarding garage sales, beauty
product sales, etc. Does anyone have a policy that would cover this
situation and can share?
