Re: Parents posting videos on You Tube or Facebook of School Activities

Guidelines and instructions for how to share with a restricted audience=A0a=
re helpful since the majority of parents=A0want to do the right thing, they=
just may not know how.=A0 It can suggest ways for parents to work it out a=
mongst themselves, without involving the school.=A0 It would also be helpfu=
l to include the laws that govern photography in public venues in your stat=
e.=0A=0AOffering tools (e.g. a password=A0protected=A0upload page and galle=
ry)=A0can help as well, though that can become labor intensive and a liabli=
ty if not properly monitored.=0A=0AAs to a policy, consult with your lawyer=
, but=A0it will likely work like this=A0 ... =0A1.=A0 Parent calls the=A0sc=
hool beacuse an unflattering picture of their child, at a school event, was=
published to=A0Flickr.=A0 They called the school because they don't want t=
o tick-off the parent who posted the picture by asking them to take it down=
or they parent has refused to take it down.=A0 They remember that the=A0sc=
hool has a policy so they can make the school=A0their agent=A0in this endev=
or.=A0 =0A2.=A0 The school contacts the parent and tells them to take down =
the whole=A0gallery since it containes a number of school pictures.=A0 It a=
lso functions as a means of shielding the parent who complained.=A0 Parent =
takes it down because they don't want to tick-off the=A0school or because i=
t is just easier.=A0=A0They grouse, to friends and family that others have =
done this in the past, and they don't see=A0what the big deal is.=A0 Unless=
.....=0A3.=A0=A0They realize that the policy is essentially unenforcable an=
d=A0the agreement has=A0very little=A0legal force because, unless the schoo=
l monitors all social networks and media sites, they are selectivly enforci=
ng their policy which makes it discrimintory.=A0 Which means the school can=
:=0Aa.=A0 Ban all=A0non-school cameras.=0Ab.=A0 Drop the policy.=0Ac.=A0 Hi=
re/Contract for services to monitor=A0social media sites.=0A=0AThere are a =
number of laws and precedents that can be used for egregious abuse by paren=
ts (e.g. damaging to the school or filmed when there was a resonable expect=
ation of privacy).=A0 So, if when push comes to shove you have an policy th=
at is a potential liablity=A0and places the school in the middle of argumen=
ts that are typically between two sets of parents with differing standards =
